Oklahoma 5-day notice to pay or quit: the late-rent demand under 41 O.S. §131

Short answer: in Oklahoma, once rent is unpaid when due, the landlord can give the tenant a written demand for payment. If the tenant doesn't pay within 5 days after that written notice, the landlord may terminate the rental agreement. The demand for past-due rent also counts as a demand for possession, so no separate notice to quit is needed.

What the law says

  • Suing for rent: if rent is unpaid when due, the landlord may sue for the rent at any time after that, or wait until the 5-day cure period runs out. 41 O.S. §131(A)
  • Terminating for nonpayment: the landlord may terminate the rental agreement if the tenant fails to pay within 5 days after written notice of the landlord's demand for payment. 41 O.S. §131(B)
  • Before or after filing: the demand may be given before or after the landlord files a suit for the rent. 41 O.S. §131(B)
  • No separate notice to quit: the demand for past-due rent is deemed a demand for possession; no further notice to quit is needed. 41 O.S. §131(B)
  • Timing: §131 has no statutory waiting period. The demand can be given as soon as rent is unpaid when due.
  • Serving the demand: §131 itself doesn't say how to serve it. Applying the Act's general service rule is common practice (our analysis; confirm with counsel): personal delivery to the tenant; if the tenant can't be found, a family member over 12 who lives there; otherwise post in a conspicuous place and mail a copy by certified mail or USPS Firm Mailing Book for Accountable Mail. 41 O.S. §111(E)
  • Not answered by §131: whether accepting a partial payment after the demand waives it, and whether late fees can be included in the demand. Ask an Oklahoma attorney before adding a late fee to the demand.
  • Late fees: Oklahoma courts treat late fees as liquidated damages. A fee that isn't a reasonable estimate of the landlord's actual loss is a void penalty (15 O.S. §§213, 215). In Sun Ridge Investors, Ltd. v. Parker, 1998 OK 22, 956 P.2d 876, a $5/day late charge on $465 rent was struck as a penalty (the $20 flat fee wasn't challenged). See also Tracy-Herald Corp. v. Jones, 2020 OK CIV APP 25 (a §131 notice was held sufficient; the court left open whether late fees count as 'rent' in a §131 demand). No statutory cap; ask counsel. Don't put a late-fee amount in the demand without counsel.
  • If the tenant doesn't pay or leave: the next step is a forcible entry and detainer (FED) case in district court. Current OSCN text sets trial 5 to 10 days after the summons is issued. Under 12 O.S. §1148.16 (amended 2023), the summons must use the Oklahoma Bar Association's plain-language form and be delivered at least 3 days before the hearing, with the hearing at least 5 days after issuance. 12 O.S. §1148.4 · last verified 2026-10-19; 12 O.S. §1148.16 · checked 2026-10-20 (Justia 2025)
  • Never lock out: a landlord who wrongfully removes or excludes a tenant can owe up to the greater of 2× average monthly rent or 2× actual damages, and the tenant may recover possession or end the lease. 41 O.S. §123 · last verified 2026-10-19

How experienced landlords do it

Practice, not law. Stricter-than-statute habits from John Ogorzalek of 5 Dogs Properties (John has owned 300+ units since 2014).

  • Wait until rent is 5 days late before serving the §131 demand, and put the due date and grace period in the lease so the timeline is never a surprise. (The statute allows the demand as soon as rent is unpaid when due.)
  • Hand the notice only to an adult (18+). If no adult is there, post it and mail it. (§111(E) allows a household family member over 12.)
  • Demand rent only. Reconcile the ledger first (credits, partial payments) and leave late fees off unless counsel has reviewed them.
  • Keep proof: a copy of the demand, the date and method of service, the certified-mail tracking number, and photos of any posting.

Steps checklist

  1. Check the ledger and lease. Confirm the rent due date, the amount past due, and every adult on the lease.
  2. Write the demand. State the past-due rent, that it's a written demand for payment under 41 O.S. §131, and that the rental agreement may be terminated if it isn't paid within 5 days.
  3. Serve it under §111(E): personal delivery → household family member over 12 → post and certified mail. Record how and when.
  4. Calendar the 5 days and note any payment that comes in. Talk to counsel before accepting a partial payment.
  5. If unpaid, talk to an attorney or your county court clerk about filing an FED. Don't change locks, remove belongings, or shut off utilities.

FAQ

How many days does an Oklahoma tenant have to pay after a written rent demand?

Five days. Under 41 O.S. §131(B), the landlord may terminate the rental agreement if the tenant fails to pay within 5 days after written notice of the landlord's demand for payment (last verified 2026-10-14). Informational, not legal advice.

Do I need a separate notice to quit after the 5-day demand?

No. Under 41 O.S. §131(B), a demand for past-due rent is deemed a demand for possession, and no further notice to quit is needed.

How soon after rent is due can I serve the demand?

Section 131 has no waiting period: the demand can be given once rent is unpaid when due. As a practice (not law), 5 Dogs Properties waits until rent is 5 days late and puts the due date and grace period in the lease.

Can I include a late fee in the 5-day demand?

Section 131 doesn't address late fees. Oklahoma courts treat late fees as liquidated damages: a fee that isn't a reasonable estimate of the landlord's actual loss is a void penalty (15 O.S. §§213, 215; Sun Ridge Investors, Ltd. v. Parker, 1998 OK 22, 956 P.2d 876). There is no statutory cap. Ask an Oklahoma attorney before including any late fee in the demand.
