Short answer: an Oklahoma landlord must return the deposit balance, without interest, within 45 days after all three of these happen: the tenancy ends, possession is delivered, and the tenant makes a written demand. Any deductions must be itemized in a written statement.

What the law says
- Escrow: any damage or security deposit must be kept in an escrow account for the tenant, maintained in Oklahoma at a federally insured financial institution. Misappropriating the deposit is a crime: up to 6 months in county jail and a fine up to twice the amount misappropriated. 41 O.S. §115(A)
- What it can cover: at the end of the tenancy, the deposit may be applied to accrued rent and to damages from the tenant's noncompliance with the Act and the rental agreement. 41 O.S. §115(B)
- Itemize in writing: deductions go in a written statement delivered by mail, return receipt requested (signed for by a person of statutory service age at that address), or in person to the tenant if they can reasonably be found. 41 O.S. §115(B)
- 45-day deadline: return the balance without interest within 45 days after termination of the tenancy, delivery of possession, and the tenant's written demand. 41 O.S. §115(B)
- No demand within 6 months: if the tenant doesn't make a written demand within 6 months after the tenancy ends, the deposit reverts to the landlord. 41 O.S. §115(B)
- Selling the property: within a reasonable time, either transfer deposits to the successor and notify tenants in writing of the transferee's name and address, or return the deposits. 41 O.S. §115(C)
- Last month's rent: unless the rental agreement says otherwise, a tenant may not apply the deposit to last month's rent or use it in place of rent at any time. 41 O.S. §115(F)
- If the landlord doesn't comply: the tenant may recover the deposit and any prepaid rent. Other damages under the Act are preserved. 41 O.S. §115(E), (G)
- No deposit cap: Oklahoma's Act sets no maximum security deposit (nothing in 41 O.S. §115 or elsewhere in the Act caps it). HB3389 (2026, pet deposit/fee limits) died.
- Pet deposits (our analysis): §115 covers "any damage or security deposit," so a pet deposit follows the same escrow, itemization and 45-day rules. Non-refundable pet fees aren't addressed by §115; they're a lease term.
- "Forfeit the whole deposit" clauses (our analysis): §115(B) allows applying a deposit only to accrued rent and damages, itemized, and has no penalty-forfeiture provision. Treat such clauses as uncertain or likely unenforceable and ask counsel.
- Assistance animals: service and emotional support animals for a person with a disability are handled as a reasonable accommodation (41 O.S. §113.2, plus the federal Fair Housing Act). Don't treat them as pets for fees or deposits without checking federal guidance and counsel.

How experienced landlords do it
Practice, not law. Habits from John Ogorzalek of 5 Dogs Properties (John has owned 300+ units since 2014).
- Document move-in and move-out the same way: a signed move-in/move-out checklist plus dated photos or video for each unit.
- Send a written list of rent-ready expenses (cleaning, repairs beyond normal wear, rekey) tied to that checklist, along with the §115 itemization.
- Use a signed pet addendum that spells out the pet fee, pet deposit, and rules.
- Ask for a forwarding address at move-out so the written statement and any balance reach the tenant.
Steps checklist
- At lease start: deposit goes into an Oklahoma escrow account at a federally insured institution; complete the move-in checklist with photos.
- At move-out: walk through, compare to move-in condition, and photograph everything.
- List deductions: accrued rent and damages from the tenant's noncompliance only, each one itemized.
- Deliver the written statement by return-receipt mail or in person, and keep the receipt.
- Calendar 45 days from the latest of: tenancy end, possession delivered, tenant's written demand. Return the balance by then.

What if the tenant never asks for the deposit back?
If the tenant doesn't make a written demand within 6 months after the tenancy ends, the deposit reverts to the landlord (41 O.S. §115(B)).
Does an Oklahoma landlord have to pay interest on a security deposit?
No. Section 115(B) says the balance is returned without interest.

Not unless the rental agreement allows it. Under 41 O.S. §115(F), a tenant may not apply the deposit to last month's rent or use it in place of rent.

Laws change, and your lease, county court practice, and federal rules (for example Fair Housing Act, CARES Act notice rules for covered properties, HUD/voucher rules) can matter too.
